Former Legislator Sues Drunk Driver and Bar that Served Him Over Crash

After a 2011 car crash left him seriously injured, a former lawmaker from North Carolina is suing the estate of the driver that was killed in the accident and the bar that plied him with too many alcoholic beverages. The Winston-Salem Journal reported that the former representative, Larry Womble, filed a lawsuit alleging that the driver of the vehicle that struck him, David Allen Carmichael, was drunk and driving recklessly.  The lawsuit also named the restaurant that allegedly served him too much alcohol before he got behind the wheel, 6th & Vine.

According to legal experts, the plaintiff has a strong case, based primarily on the fact that Carmichael’s blood-alcohol level was 0.29, which is more than three times the legal limit!  Evidence also shows that it was Carmichael’s car that crossed the centerline and collided with Womble’s vehicle.

Former representative Womble is seeking ten-thousand dollar in punitive and compensatory damages.  His lawyers believe that to be a just and suitable sum, seeing as how the defendant was under the influence and the bar that served him continued to do so, even though he was obviously intoxicated.
